Ano ba ang katotohanan tungkol sa Labor Only Contracting?

Marami na po na-interview na aspirants ang Samahan ng Makabayang Cabuyeno (SAMACA) sa Cabuyao City at ang isa sa palaging naitatanong ay ang tungkol sa Labor Only Contracting. Ang nakakalungkot po lamang ang lagi nilang tugon ay batas na daw po iyan at nasa national level at wala na daw pong magagawa ang lokal na pamahalaan tungkol dyan. Ako po ay lubos na nababahala sa mga ganitong katugunan, ano ba talaga ang batas sa paggawa? Wala na nga bang pag-asa ang ating mga kababayan na magkaroon ng Security of Tenure? Ito po ay nagbunsod sa akin na tanungin muli ang aking sarili "Meron nga bang batas na nagbibigay ng daan sa ganitong sitwasyon?". Akin pong muling binalik-balikan ang Labor Code of The Philippines eto po ang mga Artikulo Tungkol sa Labor Only Contracting, Sub-contractor:

Labor Code of the Philippines – Book III – Conditions of Employment

Art. 106. Contractor or subcontractor. Whenever an employer enters into a contract with another person for the performance of the former’s work, the employees of the contractor and of the latter’s subcontractor, if any, shall be paid in accordance with the provisions of this Code. In the event that the contractor or subcontractor fails to pay the wages of his employees in accordance with this Code, the employer shall be jointly and severally liable with his contractor or subcontractor to such employees to the extent of the work performed under the contract, in the same manner and extent that he is liable to employees directly employed by him. The Secretary of Labor and Employment may, by appropriate regulations, restrict or prohibit the contracting-out of labor to protect the rights of workers established under this Code. In so prohibiting or restricting, he may make appropriate distinctions between labor-only contracting and job contracting as well as differentiations within these types of contracting and determine who among the parties involved shall be considered the employer for purposes of this Code, to prevent any violation or circumvention of any provision of this Code. There is "labor-only" contracting where the person supplying workers to an employer does not have substantial capital or investment in the form of tools, equipment, machineries, work premises, among others, and the workers recruited and placed by such person are performing activities which are directly related to the principal business of such employer. In such cases, the person or intermediary shall be considered merely as an agent of the employer who shall be responsible to the workers in the same manner and extent as if the latter were directly employed by him.

Malinaw po ang batas at may kaukulang proteksyon ang ating mga mamamayan laban sa eksploytasyon. At malinaw din po na hindi pinapayagan or Illegal ang "Labor Only Contracting". Eto po ang RULES IMPLEMENTING ARTICLES 106 TO 109 OF THE LABOR CODE, AS AMENDED. Marami na rin pong mga naging desisyon ang Spreme Court tungkol sa Labor Only Contracting.

Kaya di po di tamang sabihin na walang magagawa ang mga lokal na pamahalaan tungkol dito. Ang kailanangan po lamang ay POLITICAL WILL sa pagpapatupad ng batas; mula sa pagbibigay ng mga permit sa mga Employment Agency, Monitoring ng mga Employment Agency na ito, at sa pakikipagusap sa mga kompanya para ipatupad ang tamang Batas Paggawa. O baka naman mga politiko mismo ang mga may-ari ng mga Employment Agencies na ito kaya sila ay nagbubulagbulagan sa issue na ito!

Di tunay na maunlad ang isang pamayanan kung ang mga mamamayan nito ay hikahos sa kahirapan!

“Kalokohan 'yung nagsasabi na [nagkaroon ng contractualization dahil] sa RA 6715. That person either does not know the law or he does not understand it at all. Ang batas na ‘yan ang nagbigay ng proteksyon sa manggawa. Dahil diyan, nagkaroon sila (workers) ng security of tenure,” he said.
 
Under Article 280 of RA 6715, the employment status of a worker engaged in activities necessary or desirable in the usual business or trade of the employer shall automatically become regular after six months, except if the worker’s employment has been fixed for a specific period of time.

Ang kailangan po lamang ay Political Will para ipatupad ang batas. Mula sa pagbibigay ng business permits sa mga sub-contractors or Employment Agencies hanggang sa pakikipagusap sa mga kompanya na ipatupad ang batas sa paggawa. O baka naman mga kamaganak ng mga politiko or kanilang mga dummy ang mga may-ari ng mga Employmant Agencies na ito kaya ayaw nilang pakialaman.
